Lets, deal with the obvious though:

(a) If she likes having sex and bangs loads of people then are a jury more or less likely to believe that she consented to the act (even if she can't remember it the next morning) than if he had porked a nun?
Showing that she is generally promiscuous will make this particular defence case more credit-worthy.

(b) More interestingly, she seems to regularly have sex while drunk. How that affects this case is difficult to gauge, as a lot would depend upon how much she had drunk, how short the gap was between her having drunk what she drank, and how quickly the alcohol got into her blood system. It sounds as if she'd drunk quite a lot, and was getting more drunk while she was having sex as her blood-alcohol levels continued to increase - which would explain how it is more than possible that both the woman and Evans are actually telling the truth.

Bottom line is, that if these other witnesses are telling the truth - and if any of us have sex with somebody that's been drinking - if the other person can't remember what happened in the morning then there's a possibility that they could get prosecuted. That's just plain wrong in my book. The issue is what state they were in when they had sex, and if they can't remember, then the jury is trying to work out whether the woman consented (while able to) and then got so bad she couldn't remember, or whether she was already just too drunk to consent. On the basis of the new evidence - that she was pretty promiscuous - the first option looks rather more likely than it did at the first trial, I would submit.

Unless the above is not an accurate version of events then how can you say that you wouldn't have sex unless asked but not speak to someone? If they didn't speak then surely she hasn't asked him to have sex?

I read it that he wouldn't have done it if she didn't ask him to, but he didn't speak to her, ie he never replied, it seems quite simple.

..seems strange that a pro footballer would try to pull a girl that was completely out of it,presumably if she had got drink spiked it was prior to meeting them , the drink spiking could have relevance
