If the accounts were fraudulent, I wonder if the Insolvency Service will be looking at director disqualification proceedings under CDDA.

That's a strong word and I'm in no position to judge whether it is technically correct.

I suppose the acid test is whether the 2016 accounts reflect Turner's statement, which we know now is complete bollux and which we know the Board knew was complete bollux the moment it was published.

A quick look at the last accounts and the Statement of Affairs at the time of the voluntary winding up, when comparing the two suggests it traded whilst insolvent, and the position regards creditors worsened by approx £180k.

Both the S of A and accounts were signed off by Liam Sutcliffe - Turner resigned as a director in 2016. Both directors will be under scrutiny as they were in office three years before the resolution to wind up was passed.

Note the S of A discloses Sutcliffe put in circa £70k as a director's loan and he stands as a creditor. I wonder if a wrongful trading claim under s214 Insolvency Act 1986 has been issued against both Sutcliffe and Turner personally for the worsening position to creditors including HMRC under their watch.

The thought of Liam Sutcliffe rocking up with £70K has made my day.

To quote the director's report:

1) Finance was provided by loans to the Company personally from representatives of Chesterfield FC of around £50,000, via Liam Sutcliffe, and from Barclays Bank Plc overdraft of £15,000.

2) There are estimated preferential claims of £800 in respect to arrears of wages . There are estimated unsecured employees' claims of £51,779 in respect of pay in lieu of notice, redundancy entitlements and unsecured arrears of wages claims. This breaks down as follows:

Arrears of pay: £49,200
Redundancy pay: £1,425
Pay in lieu of notice: £1,154

These monies are due to Liam Sutcliffe.

This claim includes the entitlements under Mr. Sutcliffe's contract of employment, as set out above, together with expenses claims of approximately £10,000 and a further £10,000 of monies introduced as working capital.

I'm reminded that, at a fans' forum at the end of the 2016/17 season, Carson pledged to recoup all monies owed to himself and the Club.

Has anyone seen any evidence of this?

Perhaps something the Ass' D's can investigate...

This would be the story/rumour/unsubstantiated claim that a young man associated with Peak FM was contacted by Nick Johnson, the CFC press officer (or whatever), and warned about mildly critical comments on social media, I guess.

But hey, at least he didn't receive threats of litigation, possibly even solicitors' statements paid for by an unnamed party, as other Town fans have...

In a nutshell, it basically says Liam Sutcliffe put the money on out of his own pocket.

Or, alternatively, he was daft enough to borrow it and inject it in the company.
