From the director's report relating to the liquidation of CFC Football Development School Ltd:

"The decision was taken for the company to cease to trade on 31 January 2016 and CFC International Football Academy Limited took on the administration of the development school from this date. The company was later rebranded as FBT International Football Academy Limited."

So Sutcliffe continued trading, presumably accepting money and obtaining credit despite deciding to wind the business up?

Isn't that fraudulent?

Or have I totally misinterpreted this...

In a word - no.

Is there evidence available that it did indeed trade before 30 June 2016- eg purchase orders, cheques written out, receipts given out, marketing material?

Shocking, I am CFO of a national charity and its stories like this that horrify me. There is new guidance this year stating that auditors must verify the claims made on the trustee report. For example if an organisation claims it has helped X amount of people then the auditor must validate this claim. A lot has been learnt in the sector following well documented recent events, changes have been made to ensure transparency and that can only be a good thing!

I'm 99.9% sure that all the staff who were employed by the old company (CFC Football Development School Ltd) were invited to reapply for their jobs during Dec 15 / Jan 16 to be part of the new company. I will check that and see if there is documentation to support the same.

What we do know is the emails that Sutcliffe's was sending months before 30/06/16 included the following footnote:

"Please note: Our accounts/Finance Department are separate to that of Chesterfield FC. Any individual, company or entity that CFC Football Development School Limited or CFC International Academy Ltd has a financial relationship must contact by email: [email protected] in the first instance."

What the directors are saying is that from 01/02/16 to 30/06/16 neither the old company, CFC Football Development School Ltd or the new company, FBT International Football Academy Ltd (CFC International Football Academy Ltd) traded!

I am now in receipt of screenshots showing payments covering wages for the period where both companies are said to have not traded!

Booth & Co have confirmed this afternoon that it is impossible to refute the former employee's claim.

Although it is highly unlikely to result in monies being repaid, it was more a point of principle.

You know about these things....
Will Booth and Co know about your latest research, the FBT Director's Report? If not, perhaps we should tell them?
Get it on, bang the gong , get it on

F.A.O John Croot & Peter Whiteley,

It is my understanding that CFC Football Development School Ltd / CFC International Football Academy Ltd (FBT International Football Academy Ltd) hire / hired the classroom facilities in the East Stand. Please can you confirm if either company hired the facilities during the period 01/02/16 to 30/06/16?

It's funny you should mention AC's son, I am sure his lad was coaching March/April 2016, perhaps even before that. Maybe AC could ask his son who he was working for given that one company supposedly ceased trading on 31/01/16 and the other was supposedly dormant!
