A couple of weeks ago there was a program on channel 4 called 24 hours in police custody, this was all about an alleged rape. There was cctv footage of this woman pretty much leading a man from a bar, and from everything you could see on various cctv cameras she was quite comfortable going back to the mans hotel room, the cctv later painted a very different picture she was very closed and defensive, kept pushing him away, flinched every time he touched her. She reported the man for rape, her word against his plus the cctv footage, a few not too brilliant witness statements, and the B****Y sheets recovered from the hotel room.

CPS decision ? Not enough evidence to proceed with a charge of rape, there was some economy of truth in both original statements but it was very obvious that while both parties had gone into the hotel room of their own free will, something happened in there that went beyond the boundaries of consent, and from seeing the woman interviewed subsequently it had obviously had a very profound and negative effect on her. It's a horrible crime that messes up a lot of lives, very very difficult to prove, almost impossible to get over, and should never be taken lightly.

I think a female going back to your room and consenting to sex (she has never denied she did) entitles you to have sex.

It doesn't mean you have to have sex, but that is a very different thing from rape, and is not against the law.

And she has never explicitly said she consented either as she couldn't remember anything, which is the grey area.

Yet the court found Clayton McDonald not guilty, who said she consented to sex with him, then when he asked if his friend could join in she said yes.

Why would he be found not guilty? Or not be charged as accessory to the proceeding act?

I repeat, this behaviour is in my opinion sleazy, and morally objectionable, but not against the law.

Ghandi was also apparently incredibly racist referring to Africans as "Kaffirs". He hated the jews stating that "they should have offered themselves to the butchers knife" during WW2. He said that India should be "left to Anarchy", cheated on his wife (ironically) and prevented his children from being educated amongst other stuff.

Probably not the best example Mr Smith could have come up with. Mandela would have been better.

er, the Mandela that was found guilty of public violence offences including a car bomb that killed 19 people? Or the Mandela that suggested literally cutting peoples noses off but later agreed with his wife that "necklacing" was a better option? He also had close ties with Castro and Arafat. He even gave the countries highest honour possible to Gaddafi after he gave money to the ANC.

Just as a thought, if he is found guilty at the retrial, wont he have done his time anyway or will he be prohibited from certain occupations as a registered sex offender? What im saying is would he be automatically sacked if found guilty?
